South Kortright, New York Man Pleads Guilty to Burglary in the Third Degree

Kyle Oakley, a 32-year-old resident of South Kortright, New York, appeared in Delaware County Court on December 18, 2023, and entered a guilty plea to the charge of Burglary in the Third Degree.

Oakley's appearance before the Honorable Gary A. Rosa, Acting Delaware County Court Judge, followed a court conference on the same day. The defendant admitted to committing the offense of Burglary in the Third Degree, classified as a Class D Felony.

The charges stem from an investigation into a March 2022 incident involving forced entry into a seasonal residence. On March 8, 2022, Delaware County Sheriff Deputy Cody Tromblee was dispatched to the scene after the homeowner reported damage to their front door. During the investigation, Deputy Tromblee discovered a Nike sweatshirt that did not belong to the homeowner. Deputy Tromblee and Undersheriff Kim Smith processed the sweatshirt and submitted it to the New York State Police Crime Lab for DNA extraction. Forensic analysis of the garment proved a match to Kyle Oakley's DNA, leading to his arrest by the Sheriff's Department.

Having pleaded guilty, Judge Rosa sentenced Oakley to a 5-year term of felony probation supervision. Additionally, the court ordered Oakley to pay $1,000.00 in restitution to the homeowner to compensate for the damages caused to their property. Failure to abide by the conditions of probation would result in a potential resentencing of 2 and 1/3 to 7 years in state prison.

Acting District Attorney Shawn Smith commended the efforts of Delaware County Sheriff Deputy Cody Tromblee and Undersheriff Kim Smith. "The Sheriff's Department conducted a thorough investigation, leading to the discovery of the defendant's DNA at the crime scene," expressed Smith. "It was this crucial DNA evidence that enabled us to secure a conviction in this case."
